1. Acceptance and scope

These Terms of Service govern access to and use of the Ohana Capital website and commissioned institutional product preview made available by Ohana Capital AG. The preview demonstrates market, portfolio, risk, reporting, security, and operator workflows using simulated financial activity.

The preview does not accept client money, provide custody, execute live orders, issue external payment instructions, or provide personal investment advice. Any future live service requires separate legal, regulatory, operating, and product approval and may be governed by different or additional terms.

By using an invited account or a feature that requires acceptance, you confirm that you have reviewed and accepted the current version of these Terms. The Privacy Policy and Risk Disclosure form part of the preview relationship.

2. Eligibility

To use the preview, you must:

  • Be at least 18 and meet the legal age required in your jurisdiction
  • Have legal capacity to enter into binding agreements
  • Be permitted to use the requested service under applicable law
  • Provide accurate, complete, and current account information
  • Complete required identity, suitability, or source-of-funds checks
  • Use the account only for yourself unless written authorization provides otherwise

Access may be unavailable or restricted based on jurisdiction, verification status, product eligibility, risk controls, or legal requirements.

3. Invited access and security

3.1 Account information

You are responsible for the accuracy of information submitted through invited access, verification, profile, and support workflows. Do not submit real payment credentials or transfer funds based on information displayed in the preview.

3.2 Credentials and access

You must protect passwords, authentication codes, recovery information, and devices used to access the account. Multi-factor authentication is available in account security settings and should be enabled where appropriate.

You must promptly notify support of suspected unauthorized access. You may not share, transfer, sell, or allow another person to operate your account.

4. Platform services

The preview may demonstrate market information, order-entry interfaces, portfolio records, modeled funding and withdrawal states, news, analytics, staking, and fixed-term product workflows. Displayed balances, positions, returns, credits, and settlements are simulated.

Market information may be delayed, incomplete, or supplied by third parties. It is provided for platform use and does not constitute investment, legal, tax, or financial advice.

5. Orders, positions, and transactions

You are responsible for treating every displayed instruction, quote, position, balance, and outcome as preview data rather than a live financial transaction.

Modeled orders may be accepted, rejected, delayed, cancelled, or repriced to demonstrate validation, liquidity, provider, and risk behavior. They are not routed to a live execution venue.

Preview records are demonstration records and are not evidence of ownership, custody, deposits, withdrawals, or executable market value.

6. Funding, withdrawals, and fees

6.1 Deposits and withdrawals

External funding and payouts are disabled. The preview does not issue a bank beneficiary, IBAN, crypto wallet, or other payment destination and does not confirm receipt or settlement of external funds. Funding, withdrawal, reconciliation, and ledger states are demonstrated with historical or synthetic records only.

6.2 Costs

Any fee, spread, financing cost, conversion cost, service charge, or product cost that applies to a transaction or product should be reviewed where it is displayed before confirmation. Costs may vary by instrument, account, provider, currency, or product term.

No fee that is not presented or otherwise agreed should be inferred solely from this document.

7. Staking and fixed-term products

Staking and fixed-term product models demonstrate lock periods, unbonding periods, early-exit restrictions, variable rewards, and maturity treatment using simulated balances. Displayed projections are illustrative and are not investment returns.

The selected product terms, asset, amount, rate, duration, maturity treatment, and withdrawal conditions shown before confirmation apply in addition to these Terms.

8. Prohibited conduct

You may not:

  • Use the platform for unlawful, fraudulent, abusive, or deceptive activity
  • Manipulate markets, prices, platform controls, promotions, or account records
  • Circumvent identity, sanctions, funding, withdrawal, security, or risk controls
  • Provide false documents or misleading account information
  • Access another account or share credentials
  • Probe, disrupt, reverse engineer, scrape, or automate the platform except through expressly authorized interfaces
  • Introduce malicious code or interfere with service availability
  • Infringe intellectual-property or privacy rights

9. Intellectual property

The platform, software, design, content, logos, and Ohana Capital brand are owned by or licensed to Ohana Capital AG. No ownership right is transferred to a user.

You may use the platform only for its intended personal or authorized business purpose. Copying, republishing, modifying, distributing, or commercially exploiting protected material requires prior permission unless applicable law permits otherwise.

10. Risk and no advice

Trading and yield products involve risk, including loss of capital. You are responsible for determining whether a service or product is appropriate for your circumstances and for obtaining independent advice when needed.

The Risk Disclosure describes material categories of risk but cannot identify every possible event or consequence.

11. Availability and responsibility

The platform may be interrupted for maintenance, provider failures, market events, security action, or circumstances outside reasonable control. We do not promise uninterrupted, error-free, or continuously available service.

To the extent permitted by applicable law, Ohana Capital AG is not responsible for indirect or consequential loss caused solely by market movement, third-party services, user devices, connectivity, unauthorized credential sharing, or instructions submitted by the user. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

12. Suspension, closure, and outstanding obligations

Access may be limited, suspended, or terminated where reasonably necessary for security, verification, legal compliance, prohibited conduct, material breach, provider restrictions, or protection of users and the platform.

You may request account closure through support. Positions, pending transactions, advances, fees, reserved funds, investigations, and record-retention obligations may need to be resolved before closure or final withdrawal.

13. Changes to these Terms

Revised Terms are assigned a new version and effective date. Material changes that require acceptance are presented through the legal-acceptance flow before continued access to protected services.

14. Applicable terms and dispute rights

Jurisdiction-specific rights, governing-law provisions, and dispute procedures may be stated in an applicable account agreement or product offer. Mandatory rights available under applicable law are not limited by this section.

This public version does not impose an arbitration forum or exclusive venue that has not been separately agreed.
